PFAS in Consumer Goods Regulated in New Mexico, USA

SGS summarizes New Mexico’s new regulation of PFAS in consumer goods.

 
Geneva (May 1, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 058.25, reporting on a new regulation to limit per- and polyfluoroalkyl (PFAS) in products in the state of New Mexico, USA.

HB 212 (Chapter 102), the Per- and Poly-Fluoroalkyl Substances Protection Act, was signed into law on April 8, 2025, by the Governor of New Mexico. The Act provides the following definitions:

• ‘Juvenile product’ – defined as a product designed or marketed for use by children under 12 years old, including children’s car seats, clothing and toys, but does not include electronic products
• PFAS – a substance in a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom

Sixteen categories of products are exempted from the prohibition requirements. The enactment of HB 212 will eventually lead to a blanket ban, with some exceptions, for PFAS in consumer products.
