SGS Summarizes Californian Proposal to Ban Bisphenols and PFAS in Certain Children’s Products

SGS publishes SafeGuardS looking at Californian proposals to regulate bisphenols and PFAS in two categories of children’s product.

 
SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 053.24 to keep stakeholders informed about California’s proposal to ban bisphenols and per- and polyfluoroalkyl substances (PFAS) in two categories of children’s products.

Senate Bill 1266 (SB 1266) was introduced in February 2024. If signed into law, the prohibition will apply, unless the substances are a temporarily essential chemical, to two categories of children’s product:
• Children’s feeding products (bottle or cup) – primarily for the consumption of liquids, foods or beverages by children younger than 12 years of age
• Children’s sucking or teething products – marketed to help a child younger than 12 years of age with sucking or teething in order to facilitate sleep or relaxation

SB 1266 defines ‘temporarily essential chemical’ as a chemical that meets all of the following conditions:
• No safer alternatives are available
• Chemical is necessary for the product’s function
• Chemical is being used in a product that is critical for the health, safety or function of society

SGS experts publish SafeGuardS to keep stakeholders informed about regulatory and market changes that may impact their business. SafeGuardS 053.24 contains details of the proposal and includes information on the revisions to the state’s Health and Safety Code that will be introduced by the bill.

The revisions are expected to become effective on January 1, 2025.
