SGS Summarizes Danish Ban on PFAS in Firefighting Foams

SGS issues SafeGuardS covering Denmark’s regulation banning the import, sale and use of PFAS in firefighting foams.

 
SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 029.24 to provide stakeholders with an overview of Denmark’s ban on per- and polyfluoroalkyl substances (PFAS) in firefighting foam (FFF) concentrates.

Executive Order No. 1360 of November 27, 2023, applies to the importation, sale and use of PFAS in FFF. It defines PFAS as any substance containing at least one fully fluorinated methyl (CF3) or methylene (CF2) carbon atom without any H/Cl/Br/I atoms attached to it.

Denmark was the first country to prohibit PFAS in food contact paper and board materials and articles in 2020. The latest piece of legislation restricts PFAS to no more than 1 mg/kg in FFF concentrates used at fire training grounds.

In addition to an exemption for FFF concentrates used in fixed firefighting systems at fire training grounds and offshore installation, there are also exemptions for PFAS regulated under:
• Regulation (EC) 1907/2006 (REACH)
• Regulation (EU) 2019/1021 on persistent organic pollutants (recast) (POP Recast)

Stakeholders should be aware the European Union (EU) is also intending to regulate PFAS in FFF and has issued a separate proposal to restrict PFAS under REACH.

The new rules came into effect on January 1, 2024. Use of non-compliant stocks of FFF concentrates at a training ground is permitted until July 1, 2024.
