The top food regulatory body stated that failure to comply with this directive could lead to consequences for food business operators (FBOs) under the FSS Act, 2006, and its accompanying rules and regulations.

 
The FSSAI in India released a statement on Friday cautioning against the sale of human milk and its derivatives, stating that the commercialization of breast milk is illegal in the country.

"This office has received input from several registered societies regarding the commercialization of human milk and its by-products." The notice pointed out that FSSAI has not permitted the processing and/or sale of human milk under the FSS Act, 2006, and related regulations.

The top food regulatory body stated that failure to comply with this directive could lead to consequences for food business operators (FBOs) under the FSS Act, 2006, and its accompanying rules and regulations.
It is recommended to cease all activities involving the sale of human milk and its derivatives without delay. The circular warned that if this rule is broken, the FBO(s) may face consequences under the FSS Act, 2006, and related regulations.

Additionally, the food regulatory agency warned that violating this directive could lead to repercussions for food business operators (FBOs) as per the FSS Act of 2006 and its corresponding regulations
The FSSAI has also recommended licensing authorities refrain from approving establishments that sell human milk. The State and Central Licensing Authorities must make sure that FBOs engaged in the production or sale of 'Mother's milk/Human milk' are not granted any license/registration.

As per the national protocols for Lactation Management Centres (LMC) at public health facilities, donor human milk is not permitted to be used for any commercial activities. This product should only be given to newborns or infants in health facilities that have fully equipped lactation management centers, and all procedures must be followed exactly.
