The law of Separation

Another modern Indian Law that has recently become well known is the Mutual consent divorce in India. The era of the empowerment has given women and men alike to decide their fate, without any social obligation. Due to specific differences, a couple may choose now to separate their ways without any further entangling in ugly legal battle. Thus when both husband and wife decides to part their ways, it is regarded as the divorce by mutual consent. In India, under Section 13-B regarding the Hindu Marriage Act of the year 1955, by filing a petition before the court, you can go for the separation where both the spouse agreeing to part ways. Mutual Divorce is the most straightforward method to go for separation procedure.

You have to keep two things in mind. One is the alimony that has to be decided by both the spouse to reach to an agreement. Another important aspect is the custody of Child. The charge of the child has to be agreed by both the parties if they want the exclusiveness over their child or want the joint custody. That too has to be decided by the spouse. For filing a petition, husband and wife have to show that they have been living separately for more than one year. Thus these two laws are relatively new in the Indian context.
