Calko Medical Center and its Partners Appalling Behavior in a Multi-Million Dollar Lawsuit

According to court documents, the counts for harassment arise from Mark Caller's tactics to intimidate HMG to drop the initial lawsuit as well as the defendants making vicious and unkind remarks.

 
Brooklyn, New York (PRWEB) January 15, 2015. Harel Media Group filed a second amended complaint in the United States District Court Eastern District of New York on January 6, 2015 against defendants Calko Medical Center, The Marcal Group, LLC, Mark Caller and Dr. Robert Kodsi.
The suit alleges that the defendants hired Harel Media Group (HMG) for the development of the Calko Medical Center website and specialized branding and marketing services. Calko Medical Center is a $61 million dollar facility developed by Mark Caller, Dr. Robert Kodsi and The Marcal Group, LLC.
The defendants in this case have exhibited appalling behavior from the outset of this case. Mark Caller has attempted to intimidate the small business owner of Harel Media Group, also known as Rafael Harel, through various methods. The level of manipulation and intimidation caused Rafael Harel a significant decline in his health and he has since been put on medication.
According to court documents, the counts for harassment arise from Mark Caller's tactics to intimidate HMG to drop the initial lawsuit as well as the defendants making vicious and unkind remarks about HMG to its business contacts, causing loss of business for HMG in the hundreds of thousands of dollars. The second amended complaint includes counts for harassment, civil conspiracy, defamation and slander, intentional infliction of emotional distress, civil theft, unjust enrichment and bad faith.
Big business is trying to decimate a small business owner by first cheating him out of full payment for his services, and then by demolishing HMG's reputation with its prospective business contacts. It's one thing to not pay someone, it's another kind of evil when you try to prevent them from being paid by ANYONE in the future.
HMG's business contacts have confirmed that it was the named defendants in this case that reached out to them and slandered HMG's name. It is a sad state of affairs when big business resorts to such petty tactics simply because the little guy asks to be paid for his services. If Mark Caller, Calko Medical Center, The Marcal Group and Dr. Robert Kodsi needed to cut corners to save money, there are other ways to do it – you don't stick it to the little guy.
The ethics and integrity of the defendants have been reprehensible. Aside from Mark Caller harassing and attempting to intimidate HMG into dropping the lawsuit, Dr. Robert Kodsi perjured himself in a December 10, 2014 filing to the court wherein he stated he had absolutely nothing to do with the case at issue.
Ironically, Harel Media Group subsequently produced about a dozen or more emails to and from Dr. Robert Kodsi about the Calko Medical Center project and marketing efforts that HMG attached to its second amended complaint. Plain and simple, Dr. Kodsi lied to the court. How can he be trusted now? In his practice or otherwise? He has now proven himself dishonest.
A party in a lawsuit deliberately lying to the court is inexcusable. There was no inadvertence or mistake here – it was a flat out lie. Dr. Robert Kodsi's conduct is shameful as society expects doctors of his stature to be honest men and women. As a matter of fact, the conduct of all defendants involved in this case has been nothing short of a disgrace.
Simply put, Harel Media Group wants what it is legally due. The defendants have not yet filed an answer to the lawsuit and are seeking dismissal based upon jurisdictional issues and other grounds. For the past six months HMG has tried to move the case along but the defendants have refused to answer the lawsuit so far, instead opting to throw everything at the wall to see what will stick for a dismissal.
Could it be that the defendants have no defense because the evidence speaks for itself? Only time will tell. But in the meantime, this case should play out as an interesting story as the case develops in court.
