FDA's arbitrary rejections impact millions, with big tobacco products predominantly authorized. Legal battles ensue.
Of the roughly 8.9 million e-cigarette products in the pmta process, more than 8.6 million have been denied to date. All products granted FDA authorization so far are big tobacco-owned.
In one ruling of many, the U.S. Court of Appeals for the Fifth Circuit ruled that the FDA acted "arbitrarily and capriciously" in rejecting the premarket tobacco product applications (pmta). More than 30 companies have taken legal action to dispute FDA denials.
